Terms of service agreement

PLEASE READ THE FOLLOWING TERMS OF USE AGREEMENT CAREFULLY. BY ACCESSING OR USING THIS SITE, INFORMATION, AND SERVICES, YOU HEREBY AGREE TO BE BOUND TO THE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT EXPRESSLY AGREE TO ALL OF THE TERMS AND CONDITIONS, PLEASE DO NOT ACCESS OR USE OUR SITE, COURSES, AND SERVICES. THIS TERMS OF SERVICE AGREEMENT IS EFFECTIVE AS OF 03/06/2021.

Introduction

This is a legally binding service agreement between Elizabeth Joy Shaffer, Therapeutic Innovations International (persons that offer services in collaboration with or through Therapeutic Innovations International will fall under “Therapeutic Innovations International through this agreement), and I (the client). The ‘Client’ includes the parent/ legal guardian/pupil or child engaging in educational programs, educational materials, or Occupational Therapy interventions from Therapeutic Innovations International and Elizabeth Joy Shaffer (and other persons providing information and services under Elizabeth Joy Shaffer or Therapeutic Innovations International). The term “site” refers to the following websites; www.thempoweredparent.com, www.resilientparent.com, www.elizabethjoyshaffer.com, www.therapyintl.com, and www.ejsot.com, and social media sites including; https://www.facebook.com/therapyintl, https://www.facebook.com/beth.millershaffer, https://www.instagram.com/elizabethjoyshaffer/.

It is important that you read this document fully and understand the conditions laid out in this document. Any participation in this service will constitute acceptance of this agreement. If you do not agree to the terms of this agreement, please contact us at elizabeth@therapyinl.com to see if accommodations can be made. Before contacting us, please read all the information below. This prevents any misconceptions regarding the content and purpose of the terms and conditions. Also, we want you to identify precisely which item(s) within this agreement concerns you. This way, we can adequately address your concerns.

Thank you for choosing the services offered by Therapeutic Innovations International. The conditions below are designed to provide complete, consistent support for you, the client. These conditions are intended to improve the overall service to clients and families.

1.0 Enquiry and booking

1.1 Initial inquiries (telephone, email, and face-to-face) of up to 15 minutes made to Elizabeth Joy Shaffer from Therapeutic Innovations International will be free of charge.

1.2 Book individual sessions or register for courses or workshops through our website, workshop

announcements, or directly with Elizabeth Joy Shaffer. When I register for a class/workshop or book a session, I understand that I will automatically be asked to confirm that I have read and agree to the terms and conditions listed here. If, for any reason, I have concerns about accepting these terms and conditions and I would like to partake in services, I know I can contact someone at elizabeth@therapyinl.com to see if accommodations can be made due to my concerns.

1.3 Full payment is required upon scheduling a session or registering for a workshop or course. If I am unable to make a session or decide to withdraw from a workshop, course, or class within 30 days of my payment, my payment will be fully refunded to me within a maximum of 15 business days upon notification and acknowledgment that my request has been received (unless item 2.4 applies to me).

1.4 Alternative Procedures: All services are virtual. Services are conducted online to allow individuals to access this type of information with minimal restrictions due to location, time, and accessibility. If I desire to have a service by alternative means due to a disability or other reason, I can send my request by email to elizabeth@therapyintl.com to make alternative arrangements.

2.0 Workshops, Courses, Meetups, and Classes

2.1 Be mindful of your time. Please sign in for the first class 5 minutes before the scheduled time. This will allow you to resolve any technical issues before class, so you will not miss any information.

2.2 The workshops, courses, and classes are where participants can grow and learn collaboratively within the group. We hope that everyone feels comfortable sharing their ideas, thoughts, and experiences that add to the topic of discussion. Participants are never required to share with the group, and if someone asks me a question and I wish not to answer, I can say, “I pass on this one” (or something similar).

2.3 One of the benefits of participating in the workshops and classes is that I will be learning from and supported by the facilitator and the other group participants. By enrolling in their workshops, courses, and classes, Therapeutic Innovations International expects that I will honor and respect the privacy of others within the group. Therefore, there should be no reference to who is in the group or what a member says or does within the group unless that person gives me direct permission to share this information in any form. Also, they are expected to do the same for me.

2.4 Recognition and respect for the ideas, experiences, circumstances, and concerns of others in the group are required to allow us to freely share our feelings within the group as each person desires. But, if the facilitator feels someone’s words and the meaning behind their comments are to purposely hurt or shame a member within the group, this person will receive an email or a call to discuss these comments. They will be provided with examples of rephrasing comments to empower and support others. If the facilitator feels this person should be removed from the group due to concerns for others, this person will be excluded from further participation in the workshop or class without being refunded for the workshop, course, or class.

2.5 I understand I have signed up for this workshop, course, or class and have agreed to the terms and conditions. I will not share the link to access materials, instructions, or other materials included in the service I paid for. If the service I am purchasing allows one other person to join me, I will only share items and materials within the service with that one person.

3.0 Individual Sessions

3.1 Session Description: Before the initial session, I may be asked to begin the assessment process by completing questionnaires or other assessments that will be used to help the provider understand my challenges and goals better.

During the initial session, the completed questionnaires or assessments will be reviewed. Together, the provider and I will evaluate current challenges and obstacles impacting my health and well-being and devise a plan to achieve my identified needs and goals. Additional sessions may be needed to achieve my goals. Progress toward goals will be reviewed, and adjustments in the plan will be made as needed.

Online sessions are live and interactive; I must have internet access, a camera, and a microphone to participate in the online virtual platform. I am responsible for scheduling my sessions. I will receive an email link to access the scheduled meeting using the Zoom platform. If I have not received the link for my scheduled meeting, I can check my spam folder or contact tii@therapyintl.com for the link. Initial sessions take 60 minutes, and follow-up sessions are 60 or 30 minutes, depending on my needs and schedule.

3.2 I understand I will be personally paying for individual sessions. I also understand that in some cases, my insurance company will reimburse me for my participation in individual sessions when services are provided under the scope of occupational therapy services. If I pursue Therapeutic Innovations International or Elizabeth Joy Shaffer services, I will make this known to my provider before sessions begin. I can contact Therapeutic Innovations International at elizabeth@therapyintl.com for more information.

4.0 Responsibility / Liability

4.1 Injury Compensation: I understand that activities and recommendations given by the facilitator or provider are given to support my goals towards increased health and well-being. Neither Therapeutic Innovations International nor Elizabeth Joy Shaffer will provide special services, free care, or compensation for any injuries that may occur. I understand that treatment for such injuries will be at my expense or paid for through my medical plan. I am responsible for my actions and choices, and it is up to me to decide if a recommendation or activity is in the best interest of my family and me. Neither Therapeutic Innovations International nor Elizabeth Joy Shaffer is responsible for injuries or any other outcomes resulting from my participating in or following instructions or information provided in any service, program, workshop, course, class, interview, website, or social media content, or video or audio recordings.

4.2 If I experience any negative responses resulting from participating in techniques, tools, practices, or activities provided during the workshops, classes, individual sessions, or on the website, I will notify the facilitator as soon as possible. I realize that none of the activities, techniques, information, tools, or practices provided are meant to cause pain or suffering. I know it is my responsibility to contact the facilitator with any concerns. This way, the facilitator can help me if I am doing something incorrectly, modify the practice, or instruct me to cease further engagement in the particular activity.

4.3 I explicitly acknowledge, understand, and agree that Therapeutic Innovations International, Elizabeth Joy Shaffer. and our subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable to me for any punitive, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages which may be related to the loss of any profits, goodwill, use, data and/or other intangible losses, even though I may have been advised of such possibility that said damages might occur and result from.

5.0 Invoicing

5.1 If I need a different receipt of payment other than what I receive after scheduling or registering for a service provided by Elizabeth Joy Shaffer or Therapeutic Innovations International, I can request to modify my receipts of payment according to my needs by emailing elizbeth@therapyintl.com

6.0 Consent

6.1 Some workshops, courses, meetups, and classes may be recorded. The reason for recording is to ensure the information covered within the workshops, courses, meetups, and classes can be accessed by those unable to attend the scheduled session. The recordings of workshops, courses, and classes will only be shared with those members who are registered for workshops, courses, and classes and will be posted either on the private Facebook group or as a private link through Therapeutic Innovations International’s YouTube channel (only to be accessed by those with the private link). All recording clips in which a participant in visual will be removed to ensure only the facilitator is seen. The recordings will be stored on devices with password protection. Monthly Monday Meetups (Parenting Tools for Special Children) are recorded, and the audio will be available to the public. If I participate in this group, I understand that the audio recordings will be publicly available.

6.2 Therapeutic Innovations International and Elizabeth Joy Shaffer's priority is to ensure the safety and privacy of all its visitors, users, and members, especially children. Therefore, it is for this reason that parents use good judgment when sharing information about themselves and their children. It is the parent’s, caregiver's, and/or legal guardian’s responsibility to determine appropriate and inappropriate information to share within this educational platform and all other communications aligned with Therapeutic Innovations International and Elizabeth Joy Shaffer.

7.0 Additional information concerning websites and services offered

7.1 The site is for informational purposes and a place to purchase or register for workshops, courses, classes, or meetups. Any and all visitors to our site, despite whether they are registered members or not, shall be deemed as “users” of the herein-contained services provided for the purpose of these terms and conditions. It is the decision of the reader to choose what information, courses, workshops, classes, content, and ideas shared by the members and guests of this site best fit their needs. The reader is responsible for any outcome from employing this information.

7.2 The intent of this site is to connect parents with information, access to a global community, and education. The term "services" refers to all methods used to share information, including; online sessions, workshops, courses, classes, website content, retreats, meetups, and interviews by Therapeutic Innovations International and Elizabeth Joy Shaffer.

7.3 The user and/or member acknowledges and agrees that the services and information provided and made available through our website and applications, which may include some mobile applications, and that those applications may be made available on various social media networking sites and numerous other platforms and downloadable programs, are the sole property of Therapeutic Innovations International and Elizabeth Joy Shaffer at its discretion, Elizabeth Joy Shaffer may offer additional website services and/or products, or update, modify or revise any current content and services. This Agreement shall apply to any and all additional services and/or products and any and all updated, modified, or revised Services unless otherwise stipulated. Therapeutic Innovations International and Elizabeth Joy Shaffer do hereby reserve the right to cancel and cease offering any aforementioned Services and/or products. As the end-user and/or member, you acknowledge, accept, and agree that Therapeutic Innovations International and Elizabeth Joy Shaffer shall not be held liable for any such updates, modifications, revisions, suspensions, or discontinuance of any of our services and/or products. Your continued use of the services provided after such posting of any updates, changes, and/or modifications shall constitute your acceptance of such updates, changes, and/or modifications, and as such, frequent review of this Agreement and any and all applicable terms and policies should be made by you to ensure you are aware of all terms and policies currently in effect. If you disagree with the updated, modified, revised, or modified terms, you must stop using the provided services.

7.4 We reserve the right to modify or withdraw, temporarily or permanently, the site (or any part of it) with or without notice to you. You agree that we shall not be liable to you or any third party for any modification to or withdrawal of the site. You will not be eligible for any compensation because you cannot use any part of the site or because of a failure, suspension, or withdrawal of all or part of the site.

7.5 We may alter these terms and conditions from time to time, and your use of the site (or any part of it), following such a change, shall be deemed your acceptance of the such change. You are responsible for regularly checking whether the Terms of Use have been changed. If you do not agree to change the Terms of Use, you must immediately stop using the site.

8.0 Global Communication

8.1 As a site user, I hereby acknowledge that by using the site to send electronic communications, which will include, but are not limited to, email, searches, instant messages, and uploading of files, photos, and/or videos, I will be causing communications to be sent through the computer network. Therefore, through my use and thus my agreement with this term and condition, I am acknowledging that the use of this service will result in interstate transmissions.

8.2 Due to the global nature of the internet, through the use of our network, I hereby agree to comply with all local rules relating to online conduct and that which is considered acceptable content. Uploading, posting, and/or transferring software, technology, and other technical data may be subject to the export and import laws of the United States and possibly other countries. By using the network, I thus agree to comply with all applicable export and import laws, statutes, and regulations.

8.3 Therapeutic Innovations International, LLC, and Elizabeth Joy Shaffer shall not lay claim to ownership of any content submitted by any visitor, member, or user or make such content available for inclusion on our website. Those areas that may be deemed “publicly accessible” areas of Therapeutic Innovations International and Elizabeth Joy Shaffer Sites are those areas of the network that are meant to be available to the general public and include message boards and groups that are openly available to both visitors and members.

9.0 General Practices

9.1 I agree not to replicate, duplicate, copy, trade, sell, resell, or exploit, for any commercial reason, any part, use of, or access to sites.

9.2 I agree that Therapeutic Innovations International and Elizabeth Joy Shaffer have no responsibility or liability for the removal or failure to maintain storage of any messages and/or other communications or content maintained or transmitted by our services. I also acknowledge that they reserve the right to delete or remove any account that is no longer active for an extended period. Furthermore, Therapeutic Innovations International and Elizabeth Joy Shaffer shall reserve the right to modify, alter and/or update these general practices and limits at their discretion.

9.2 Therapeutic Innovations International and Elizabeth Joy Shaffer shall reserve the right at any time it may deem fit to modify, alter and or discontinue, whether temporarily or permanently, our service, or any part thereof, with or without prior notice. In addition, we shall not be held liable to you or any third party for any such alteration, modification, suspension, and/or discontinuance of our services or any part thereof.

10.0 Disclaimers

10.1 Therapeutic Innovations International and Elizabeth Joy Shaffer may provide links to other websites and/or resources. Thus, I agree that they are not responsible for the availability of such external sites or resources. They do not endorse nor are they responsible or liable for any content, products, services, advertising, or any other materials, on or available from such websites or resources. Furthermore, I acknowledge and agree that Therapy Innovations International and Elizabeth Joy Shaffer shall not be responsible or liable, directly or indirectly, for any such damage or loss which may be a result of, caused, or alleged to be caused by or in connection with the use of or the reliance on any such content, goods or services made available on or through any such site or resource.

10.2 I acknowledge and agree that Therapeutic Innovations International and Elizabeth Joy Shaffer services and any essential software used in connection with services (“Software”) shall contain proprietary and confidential material protected by applicable intellectual property rights and other laws. Furthermore, I acknowledge and agree that any information and content in any advertisements or information presented by and through services or advertisers is protected by copyrights, trademarks, patents, or other proprietary rights and laws. Therefore, except for that which is expressly permitted by applicable law or as authorized by Therapeutic Innovations International and Elizabeth Joy Shaffer or such applicable licensor, I agree not to alter, modify, lease, rent, loan, sell, distribute, transmit, broadcast, publicly perform and/or create any plagiaristic works which are based on Elizabeth Joy Shaffer in whole or part unless provided a link to share such information.

10.3 Therapeutic Innovations International and Elizabeth Joy Shaffer have granted me personal, non-transferable, and non-exclusive rights and/or license to make use of the materials and information on a single computer, as long as I do not, and shall not, allow any third party to duplicate, alter, modify, create or plagiarize work from, reverse engineer, reverse assemble or otherwise make an attempt to locate or discern any source code, sell, assign, sublicense, grant a security interest in and/or otherwise transfer any such right in the software. Furthermore, I agree not to alter or change the materials or software in any manner, nature or form, and as such, not to use any modified versions of the software, including and without limitation, to obtain unauthorized access to the services. Lastly, I also agree not to access or attempt to access services through any means other than through the interface provided by Therapeutic Innovations International and Elizabeth Joy Shaffer.

10.4 Any information or material downloaded or otherwise obtained through this site, Therapeutic Innovations International, and Elizabeth Joy Shaffer services or software shall be accessed at my sole discretion and sole risk. As such, I shall be solely responsible for and hereby waive any and all claims and causes of action concerning any damage to my computer and/or internet access, downloading and/or displaying, or for any loss of data that could result from the download of any such information or material.

11.0 Copyright and intellectual property

11.1 I acknowledge, understand, and agree that all of the Therapeutic Innovations International and Elizabeth Joy Shaffer trademarks, copyright, trade name, service marks, and other Therapeutic Innovations International and Elizabeth Joy Shaffer logos and any brand features, and/or product and service names are trademarks and as such, are and shall remain the property of Therapeutic Innovations International and Elizabeth Joy Shaffer. I herein agree not to display and/or use the Therapeutic Innovations International and Elizabeth Joy Shaffer logo or marks in any manner.

11.2 Copyright or intellectual property infringement claims.

Therapeutic Innovations International and Elizabeth Joy Shaffer will always respect the intellectual property of others and ask all of our users to do the same. If I feel that my work has been duplicated in such a way that would constitute copyright infringement, or if I believe your intellectual property rights have been otherwise violated, I should provide the following information:

A description of the copyrighted work or other intellectual property that you believe has been infringed upon;

- A description of the location of the site, which I allege has been infringing upon my work;

- My physical address, telephone number, and email address;

- A statement in which I state that the alleged and disputed use of my work is not authorized by the copyright owner.
